Terms of Use
These Terms of Use (“Terms”) are an agreement between you and Soma Practice (“Soma”, “we”, “us”) and govern your use of the Soma Practice iOS app and the somapractice.io website (together, the “Service”). By downloading or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Not medical advice
Soma offers short, guided body-based practices for general wellness and self-care. The Service is not a medical device and does not provide medical, psychological, or psychiatric advice, diagnosis, or treatment. It is not a substitute for care from a qualified professional.
- Talk to your doctor or therapist before using the Service if you have a medical or mental health condition, are pregnant, are recovering from injury, or have a history of trauma for which you are receiving or may need treatment.
- Body-based practices can sometimes bring up strong sensations or emotions. If a practice feels overwhelming or causes pain, dizziness, or distress, stop and, if needed, seek professional support.
- Do not use the Service while driving, operating machinery, or in any situation that requires your full attention.
- If you are in crisis or think you may have an emergency, call your local emergency number immediately. The Service is not designed for emergencies.
You use the practices at your own risk and are responsible for deciding whether they are appropriate for you.
2. Who can use the Service
You must be at least 13 years old (or 16 if you live in the EEA or the UK) to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or guardian, who agrees to these Terms on your behalf.
3. Your account
You can use the app without signing in; in that case your access is tied to an anonymous account on your device. You may choose to sign in with Apple or Google to keep your data and subscription available across devices. You are responsible for activity under your account and for keeping your devices and sign-in credentials secure.
4. Subscriptions and free trial
Some content and features require a paid, auto-renewing subscription (“Premium”), offered on a monthly or annual basis.
- Billing. Subscriptions are purchased through Apple’s In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase. The price is shown in the app before you buy and may vary by region.
- Auto-renewal. Your subscription renews automatically for the same period and at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Free trial. If a free trial is offered and you are eligible, it converts to a paid subscription when the trial ends unless you cancel at least 24 hours before it ends. Trial eligibility is determined by Apple and is generally available once per Apple ID.
- Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app does not cancel your subscription. After you cancel, you keep access until the end of the period you already paid for.
- Refunds. Purchases are processed by Apple and are subject to Apple’s refund policies. We cannot issue refunds for App Store purchases ourselves; you can request one at reportaproblem.apple.com. Nothing in these Terms limits any refund or withdrawal rights you have under the laws of your country.
- Price changes. We may change subscription prices. Any change will apply no earlier than your next renewal, and you will be notified in advance as required by Apple and applicable law.
5. License and acceptable use
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use on Apple devices you own or control, as permitted by the App Store’s usage rules.
You agree not to:
- copy, record, redistribute, sell, or publicly perform the practices or other content of the Service;
- reverse engineer, decompile, or attempt to extract the source code of the app, except where the law allows it despite this restriction;
- circumvent the subscription, access the Service by automated means, or interfere with its operation or security;
- use the Service in any way that violates applicable law.
6. Intellectual property
The Service, including its practices, texts, visuals, animations, design, and software, is owned by us or our licensors and is protected by intellectual property laws. Except for the license above, these Terms do not give you any rights in the Service.
7. Privacy
Our Privacy Policy explains what information we collect and how we use it.
8. Changes to the Service and termination
We may add, change, or remove features and content, and we may suspend or discontinue the Service or any part of it. We may suspend or terminate your access if you materially breach these Terms. You may stop using the Service at any time; remember to cancel any active subscription in your Apple ID settings. Sections that by their nature should survive termination will survive.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any practice will produce a particular result.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim arose and USD 50.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, or affects your statutory rights as a consumer.
11. Apple-specific terms
These Terms are between you and us, not Apple Inc. (“Apple”). Apple is not responsible for the app or its content. To the extent these Terms are less restrictive than the usage rules in the Apple Media Services Terms and Conditions, the latter apply.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection or similar laws.
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator of the Service is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of that country.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and if the changes are significant we will give you additional notice in the app or on this website. By continuing to use the Service after the changes take effect, you agree to the updated Terms.
14. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
